Teddy Casiño (Bayan Muna Party-list)<BR/>Fourteenth Congress, House of Representatives (First Regular Session)<BR/>December 11, 2007<BR/> <BR/>Mr. Speaker:<BR/> <BR/>I stand on a question of personal and collective privilege on the plight more than 4,000 civil engineering graduates who have been rendered an extreme injustice by the Professional Regulatory Commission.<BR/> <BR/>Mr. Speaker, on November 17 and 18, 2007, four thousand seven hundred eighty two (4,782) graduates of Bachelor of Science in Civil Engineering took the Civil Engineering Licensure Examination administered by the Professional Regulation Commission (PRC), in eight testing centers in the cities of Manila, Baguio, Cagayan de Oro, Cebu, Davao, Iloilo, Legaspi and Tacloban.<BR/> <BR/>The examination came and went quietly without any hitch until a mysterious, questionable and highly illogical decision by the PRC, upon recommendation of the Board of Civil Engineering, came out on November 23, 2007.<BR/> <BR/>Unknown to all the examinees, the PRC promulgated Resolution No. 07-12 recommending the nullification of the examination results in two subjects: Hydraulics and Geotechnical Engineering, and Structural Engineering and Construction. They also required ALL the examinees to retake the same subjects on January 12, 2007.<BR/> <BR/>Mr. Speaker, dear colleagues, this is a controversy where the PRC, again, is at the center and the head of the problem.<BR/> <BR/>Information my office has gathered reveal that the PRC approved the said recommendation of the Board of Civil Engineering without conducting a thorough and transparent investigation to afford due process to the examinees. The examinees, in fact, only learned of the said decision to have a retake only through the mass media when the PRC issued an announcement on November 26, 2007. The examinees only got hold of Resolution No. 07-12 on December 6, 2007 when they initiated a dialogue with the PRC and the members of the Board of Civil Engineering.<BR/> <BR/>Such actions is not only unprofessional on the part of the PRC but worse, a deceptive move on the part of the Commission that effectively branded the whole batch – I mean ALL examinees -- as cheaters without the benefit of an open and thorough investigation.<BR/> <BR/>Let me emphasize that this is unlike last year's nursing exam controversy, where review centers were proven to be involved in the systematic cheating after a number of students exposed their modus operandi. This time, the PRC nullified the examination results of one subject, Hydraulics and Geotechnical Engineering, simply because in its view, it was “statistically improbable” that 461 our of 4,782 examinees perfected the exam.<BR/> <BR/>On the other hand, the results of the examination on another subject, Structural Engineering and Construction, was also nullified because not because there was massive cheating but simply because two examinees were caught cheating using their mobile phones, one of which contained answers to 30 questions of which 21 were found to be correct.<BR/> <BR/>It appears that PRC Chair Leonor Tripon-Rosero, Board of Civil Engineering Chairman Angel Lazaro III, and members Apollo S. Enriquez and Pedro Adonis Compendio are too gung-ho in assuming and branding the whole batch as cheaters in the two subjects by way of nullifying the results and calling for a retake. They are also downright lazy since they made their decision without conducting an appropriate investigation.<BR/> <BR/>Mr. Speaker, dear colleagues, the PRC decision to nullify the said examination results has no factual and legal basis as there is no law or rule that has set a standard regarding “statistically improbable results.” So what if 461 examinees got perfect scores? If there is no evidence that they cheated, and none have been presented so far, then the PRC will simply have to accept the fact that there are 461 brilliant engineering graduates, at least in so far as hydraulics and geotechnical engineering is concerned.<BR/><BR/><BR/>As to the act of cheating using mobile phones as codigo, the evidence gathered so far is only enough to nullify the exam results of ONLY two persons and to suspend them from taking the examinations for the next 2 years, as provided under PRC Resolution No. 463 dated November 27, 1996.<BR/> <BR/>Clearly, the PRC has acted with undue haste in nullifying the examination results and ordering a retake thereof without first conducting a fair and thorough investigation. By its paranoid actions, the PRC is ironically undermining the integrity of the Civil Engineering profession.<BR/> <BR/>We believe that the PRC, in issuing the official announcement nullifying the examination results, violated the right to due process of all the examinees. This abrupt PRC decision requiring all the examinees to retake the exams is simply an act of injustice. Sure, those caught cheating should be penalized. But the PRC decision penalizes the whole batch of examinees on the flimsy basis of statistical improbability in one exam and because two cheaters were caught in another.<BR/> <BR/>Mr. Speaker, everyone deserves an explanation. In the absence of an appropriate law that has set the standards, grounds and the appropriate process for the PRC and/or the boards under its supervision to observe before they could order the nullification of examination results in any of the professions under its powers, it would be appropriate to hear the demands of the civil engineering examinees.<BR/> <BR/>We call on the PRC to stop or at least postpone the retake of the two subjects in the civil engineering licensure exams on January 12, 2007 pending a thorough, fair and transparent investigation.<BR/> <BR/>The PRC should also immediately release the results of the examination and schedule the oath-taking of those who passed the examination and penalize those found guilty of cheating in the licensure exams.<BR/> <BR/>Mr. Speaker, if the PRC wants to clean up its controversial image, it should not seriously damage the professions that it exercises regulatory powers on the way it has done to the nursing profession and now, the civil engineering profession.<BR/> <BR/>This Representation fully believes that it should penalize those who run afoul of the law. But it should not result in the wholesale nullification of exam results just because it has discovered “statistical improbabilities” that they themselves cannot explain since they have not investigated anything.<BR/> <BR/>The PRC must explain to this Chamber why it has resorted to violating the rights of due process of all the civil engineering licensure examinations.<BR/> <BR/>Mr. Speaker, we have to help these future engineers whose reputations have been debased by the highly unprofessional acts of the PRC. One of their colaborators who <BR/>finished the exam ahead of them sent the answers to him by text. That <BR/>explains why only 21 out of 30 were correct. Either the examinee-<BR/>sender is not a very brilliant student, or he intentionally sent <BR/>correct answers equivalent only to passing (70%) (para hindi sya <BR/>agrabyado) PRC can easily check the accuracy of this information by <BR/>asking NBI to interrogate T*****and J****** and their respective <BR/>boardmates/barkada. <BR/><BR/>IS THE RESULT IN GEOTECHNICAL ENGINEERING STATISTICAL IMPROBABLE?<BR/>Let me explain this very clearly and CORRECTLY!<BR/>Statistics is a record or records of set of scores that already <BR/>happened in the PAST.<BR/>You ask all veteran instructors of the more than 1000 colleges, <BR/>schools and <BR/>universities in the Philippines if they never had at least an exam <BR/>where 1/10 <BR/>of their students got perfect score. 1/4 got above 90% score. 1/2 got <BR/>above <BR/>70% rating. They certainly had at least one exam with such <BR/>statistics. That <BR/>means, the record set by CE examinees in the Nov 2007 Board exam is <BR/>not <BR/>new, nor seldom. <BR/>Probability is a rational number from 0 to 1 which is the numerical <BR/>expression of the <BR/>strength of possible occurence of an outcome. <BR/>It means negative number, numbers more than "1" , irrational numbers <BR/>like <BR/>1/pi and 1/e cannot be values of probability.<BR/>But 1/10, 1/4, and 1/2 (ratio of students who got 100%, above 90%, <BR/>and above <BR/>70% respectively in the subject Geotechnical Engineering) are all <BR/>rational <BR/>numbers between "0" and "1". <BR/>Thus, while such set of score may be unfrequent or worse, rare, but <BR/>DEFINITELY, they are VERY MUCH STATISTICALLY AND MATHEMATICALLY <BR/>PROBABLE.<BR/><BR/>I know that Dr Ibe, former acting commissioner and now PRC consultant <BR/>in test construction and statistics, will agree with me that "an exam <BR/>in which a lot of students fail or get too many low scores could be <BR/>due to the following reasons: 1)Irrelevant Questions, 2) Unexpected <BR/>question 3) too difficult questions, 4) too short a time allotted, <BR/>and 5) too many WEAK Students 6) POOR TEACHERS.<BR/>None of the five reasons above is present in the SAID SUBJECT. <BR/>1. Questions are RELEVANT: Those are very much just fluid mechanics <BR/>and geotechnical engineering.<BR/>2. They are all EXPECTED QUESTIONS. All are mere repetitions of <BR/>previous Exams by the same examiner except for the given.<BR/>3. Most students even undergrads will agree that ALL questions are <BR/>EASY<BR/>4. Four(4) Hours as usual is so much more than enough for 27 <BR/>questions of such degree of difficulty. <BR/>5. If there is no way to prove that the examinees in the said board <BR/>exam are better, likewise, NO WAY to prove that too many are weak.<BR/>6. Same logic in number 5<BR/>THUS, THERE IS NO REASON WHY A LOT OF STUDENTS WILL GET LOW SCORES IN <BR/>SAID SUBJECT.<BR/><BR/>On the other hand, possible reasons for a set of very high turnout of <BR/>very high scores are the following: 1)Very manageable/easy <BR/>Questions , 2) Expected/Repeated Questions, 3) Very ample time <BR/>allotted, 4) Too many Inteligent students, or 5) there is a MASSIVE <BR/>leakage!<BR/><BR/>Numbers 1,2, and 3 are very much satisfied by the exam in the subject <BR/>of "Fluid Mechanics and Geotechnical Engineering" . <BR/><BR/>You don't need Number 4 to get high turnout of high scores if Numbers <BR/>1 to 3 are satisfied.<BR/><BR/>To say that there WAS a MASSIVE leakage/cheating is NOT JUST <BR/>IMPROBABLE. IT IS IMPOSSIBLE!! !!<BR/><BR/>If there was a leakage, CHEATERS DON'T NEED A CELL PHONE. They will <BR/>rather have a hard copy or just memorize the answers.<BR/>In Manila, Baguio City, cell phones were collected by proctors and <BR/>returned only after the exam.<BR/>In Cebu, cell phones were collected, examinees were bodily searched, <BR/>pockets were reversed, socks were removed and inspected, shoes were <BR/>asked to be removed for inspection. That's how strict the <BR/>implementation of exam in Cebu was. <BR/><BR/>While Cheating is probable, MASSIVE ORGANIZED CHEATING IS NOT<BR/><BR/>AUGUST 2002 MARINE DECK Board exam as a precedent? <BR/>In the abovementioned Board Exam, a hardcopy of answers (98 of 100 OF <BR/>THEM CORRECT) was found in the possession of at least one examinee! <BR/>The subject with an unusually high scores and high turnout of passing <BR/>scores was in that subject where the said answer key was confiscated. <BR/>Obviously, this case is not parallel to what happened in Nov 2007 CE <BR/>Board Exam and thus, cannot be the basis for RETAKE ORDER.<BR/><BR/>2006 NURSING BOARD EXAM <BR/>In the abovementioned Board exam,actual Questions in the Board exam <BR/>already leaked out before the actual exam. There were no such in the <BR/>CE Board exam.<BR/><BR/>CONCLUSION AND RECOMMENDATIONS:<BR/><BR/>1. THERE WAS NO LEAKAGE OF QUESTIONS THAT HAPPENED!<BR/><BR/>2. CHEATING WAS COMMITTED BY ONLY A HANDFUL OF EXAMINEES ONLY IN <BR/>CAGAYAN DE ORO CITY AND WAS MADE POSSIBLE BY THE CONSISTENT <BR/>NEGLIGENCE OF PRC OFFICIALS THERE. <BR/><BR/>3. THE RATING IN THE SUBJECT OF "FLUID MECHANICS & GEOTECHNICAL <BR/>ENGINEERING" IS STATISTICALLY VERY MUCH PROBABLE.<BR/><BR/>4. STOP THE MENTAL AND EMOTIONAL TORTURE OF THE EXAMINEES BY <BR/>IMMEDIATELY RELEASING THE RESULT OF THE EXAM SOONEST <BR/><BR/>5. DEFER EXAM RESULTS OF ONLY STUDENTS CAUGHT WITH THEIR CELL PHONE <BR/>AND THEIR RESPECTIVE BOARDMATES/BARKADAS /SCHOOLMATES<BR/><BR/>6. The Commission nullified the two subjects in the said exam, namely Hydraulics and Geotechnical Engineering, and Structural Engineering and Construction due to some “irregularities”. <BR/><BR/> <BR/><BR/>According to PRC, in the subject Hydraulics and Geotechnical Engineering, the results were “statistically improbable” due to the unusually high grades obtained by the examinees in the said exam. In the subject Structural Engineering and Construction, two (2) examinees were caught in possession of mobile phones, one of which contains answers to thirty (30) questions wherein twenty one (21) were found to be correct.<BR/><BR/> <BR/><BR/>The following is the timeline of the CE retake controversy: <BR/><BR/> <BR/><BR/>27 November – the examinees first learned of the alleged irregularities and retake through TV news program.<BR/><BR/> <BR/><BR/>28 November – they obtained a copy of the official announcement from the Professional Regulation Commission which was officially released on November 26, 2007. Neil Erich Galicia, a graduate of Ateneo de Naga University, initiated to call a meeting to discuss the necessary actions to be taken. Petitioners wrote an open letter to the Commission seeking reconsideration of its decision to nullify the examination results of the two (2) subjects. <BR/><BR/> <BR/><BR/>29 November – CE AGRESSION called the attention of the media and requested for a press conference. Unfortunately, the said conference was cancelled because of the The Peninsula Standoff incident. The group, instead, discussed the next planned actions including a mobilization and seeking of legal assistance.<BR/><BR/> <BR/><BR/>30 November – the group continued the meeting and finalized the preparations of the first mobilization scheduled on December 3, 2007.<BR/><BR/> <BR/><BR/>01 December – Dianne May Casimiro, head of the campaign committee, requested for the support of the other student groups of the Polytechnic University of the Philippines (PUP). <BR/><BR/> <BR/><BR/>02 December – Rachel Ann Apuan, head of the Legal committee met Atty. Jobert Pahilga of the National Union Lawyers’ of the Philippines (NULP) to personally discuss and finalize the petition.<BR/><BR/> <BR/><BR/>03 December – At 10:00 AM, the CE AGRESSION held a rally marching from P. Noval Street Sampaloc Manila to the PRC. Along with the mobilization, the group officially filed the petition to the Office of the Chairperson of the PRC and requested for a dialogue/ meeting with all concerned officials.<BR/><BR/> <BR/><BR/>04 December – the group received a confirmation of dialogue/ meeting with the PRC scheduled on December 6, 2007, at 10:00AM at the Conference Room of PRC. Representatives from different colleges and universities met to prepare for the said dialogue/ meeting. Galicia and Atty. Pahilga were invited for a live news interview with Ces Drilon of ANC “PrimeNews” to discuss the issue.<BR/><BR/> <BR/><BR/>05 December – Atty. Pahilga met the representatives to orient them with the dialogue. They also reevaluated the details of the petition and of the issue itself.<BR/><BR/> <BR/><BR/>06 December – the dialogue/ meeting. The following concerns and issues were raised during the two-hour deliberation:<BR/><BR/> <BR/><BR/>1. The Commission will decide on the petition of the examinees before the ordered retake on January 12, 2008.<BR/><BR/> <BR/><BR/>2. The Commission will not withdraw the ordered retake but suggested an OPTIONAL RETAKE to the examinees. The optional retake can be taken by the examinees while the investigation is still on-going. If an examinee passed the retake examination, PRC will recognize the result regardless of the result of the investigation in the petition. But if an examinee failed on the retake examination but passed the November 2007 Board Exam, he/she will still get a passing rate if the petition of the Union succeeds. <BR/><BR/> <BR/><BR/>3. CE AGRESSION will not withdraw its petition filed to PRC. In this connection, CE AGRESSION will file a motion to speed up the investigation and their decision regarding the issue.<BR/><BR/> <BR/><BR/>4. PRC Resolution No. 07-12 states that the examination result in the subject Hydraulics and Geotechnical Engineering is “statistically improbable” because of the unusually high grades/ratings obtained by 461 of the 4782 examinees who got a perfect score.<BR/><BR/> <BR/><BR/>5. Dr. Milagros Ibe, the Consultant of the Commission on Test Construction and Statistics, recommended for the nullification of the examination result in Hydraulics and Geotechnical Engineering because of its statically improbability. CE AGRESSION is not convinced on the conclusion made by Dr. Ibe because the only basis is statistics. She did not include the level of difficulty of the questions as a primary basis.<BR/><BR/> <BR/><BR/>6. PRC confirmed that there are no irregularities in Hydraulics and Geotechnical Engineering but stated that the unusual high grade is an irregularity by itself.<BR/><BR/> <BR/><BR/>7. The Commission also attested that there is an incident of cheating happened in Cagayan de Oro testing center. According to them, these are already investigated and there will still be further investigation.<BR/><BR/> <BR/><BR/>8. PRC stated that they are open to ideas of postponement of the date of retake examination and retake for all subjects.<BR/><BR/> <BR/><BR/>9. Dr. Lazaro confirmed that there is no leakage on the November 2007 Civil Engineering Board Exam.<BR/><BR/>.<BR/><BR/><BR/>By this, the Secretariat and the lawyers of CE AGRESSION are officially requesting the position of the 4,782 examinees through their schools on their consensus of:<BR/><BR/> <BR/><BR/>1. CE AGRESSION shall pursue the case and shall stand firm to “No Retake” until the investigation is completed. It will petition the courts to stop/enjoin the retake on January 12, 2008;<BR/><BR/> <BR/><BR/>2.
